Terms of Service
These Terms govern your use of tutorcake.com and academy.tutorcake.com (the “Services”) operated by TutorCake. By purchasing a product, creating an account or using the Services you agree to these Terms.
1. Accounts
You must be 18 or older to create an account or make a purchase. You are responsible for keeping your password and your children’s PINs confidential and for all activity under your account. Student profiles may be created only by a parent or legal guardian.
2. Digital products (Reading Power Packs)
Reading Power Packs are digital PDF downloads licensed for personal, non-commercial use by your household or, for teachers, your own classroom. You may print as many copies as you need for that use. You may not resell, redistribute, share the files publicly, or use them to create derivative products. Because the products are delivered instantly, all sales are final; if a file is defective or you cannot access your download, contact us and we will make it right.
3. Academy subscriptions
Academy plans are billed in advance, monthly or annually, to the payment method on file and renew automatically until cancelled. You may cancel at any time from your billing page; access continues until the end of the paid period and no partial refunds are given for unused time. Plan changes take effect as described at checkout (upgrades immediately with proration; downgrades at the next renewal). We may change prices with at least 30 days’ notice by email; changes apply at your next renewal.
4. Free trials and promotions
Trial access and coupon codes are offered at our discretion, may be limited to one per household, and may be withdrawn or modified at any time. Unless stated otherwise a trial converts to a paid subscription at the end of the trial period unless cancelled before then.
5. Acceptable use
You agree not to misuse the Services, including by attempting to access other users’ data, interfering with the operation of the Services, scraping content, or using automated tools to create accounts. We may suspend or terminate accounts that violate these Terms.
6. Intellectual property
All content on the Services — stories, passages, questions, illustrations, characters (including Toby the Turtle, Finn the Fox, Oliver the Otter, Rocky Raccoon, Scout, RT and Ms. Sugarton), videos, software and trademarks — is owned by TutorCake or its licensors and protected by copyright and trademark law. Nothing in these Terms transfers any ownership to you.
7. Educational disclaimer
TutorCake provides supplemental reading practice. It is not a substitute for school instruction, individualized evaluation, or professional educational services, and we make no guarantee of specific academic outcomes.
8. Disclaimer of warranties and limitation of liability
The Services are provided “as is.” To the fullest extent permitted by law, TutorCake disclaims all warranties, express or implied, and will not be liable for indirect, incidental or consequential damages. Our total liability for any claim relating to the Services is limited to the amount you paid us in the twelve months before the claim.
9. Governing law
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Florida, and you consent to their jurisdiction.
10. Changes and contact
